In the first half, David Colapinto interviews William “Bill” Binney, a former employee of the National Security Agency (NSA), who blew the whistle on the secret surveillance of everyday communications by American citizens.  Mr. Binney will explain the extent of NSA’s illegal data-gathering since 9/11, and describe the government’s attempts to silence and intimidate him from speaking out about the evisceration of Americans’ privacy.

In the second half, Lindsey Williams will interview David Colapinto about how the new Presidential Policy Directive will actually affect national security whistleblowers, like Mr. Binney.

Honesty Without Fear - 10/01/12

In the first half hour, Richard Renner interviews Arizona attorney Vikram Badrinath about his recent amicus brief to the Board of Immigration Appeals.  Writing on behalf of the American Immigration Lawyers Association (AILA), Badrinath argues that whistleblowers should be eligible for political asylum on the basis of their membership in a particular “social group,” even though their membership might not be visible to strangers.  He also argues that the same “social group” basis for asylum should apply to people of minority sexual orientations, to women who oppose female genital mutilation, and to those who have testified against gangs.  The case arises from an asylum application by Mauricio Valdiviezo-Galdamez, a Honduran who fled after testifying against the MS-13 gang.

In the second half hour, Jane Turner interviews retired New Jersey State Police trooper, Detective Sgt. 1st Class Brian Royster, who was retaliated against after complaining the division failed to appropriately investigate claims such as racial discrimination and sexual harassment. Royster was recently awarded $1.06 million for emotional distress, lost pension and back pay.

One of the most significant impediments for whistleblowers seeking to vindicate their rights is their inability to get lawyers to take their cases. The National Whistleblowers Center is contacted by thousands of whistleblowers a year, and most of them are unable to get any lawyer to take their case. Richard Renner spends the hour providing whistleblowers with guidance on how to sell your case to an attorney, present the key facts that may interest a lawyer in taking on your case, ask the right questions, and get the attention your case deserves.

Honesty Without Fear - 09/17/12

In the first half, Richard Renner and Dr. Patricia Harned, President of the Ethics Resource Center (ERC), discuss the findings of the ERC’s recently-released report on whistleblowing.  The report ,“RETALIATION: When Whistleblowers Become Victims,” found that, “not only is retaliation on the rise nationally, it is rapidly becoming an issue even at companies with a demonstrated commitment to ethics and integrity.”

In the second half, Lindsey Williams interviews Steve Kohn about the case of UBS whistleblower Bradley Birkenfeld. Tune in to find out why his prison sentence was unjustified, why the IRS awarded him $104 million, and why a presidential pardon is essential to stopping illegal offshore banking.

Honesty Without Fear - Contract Fraud and Tobacco Racketeering - 08/28/12

In the first half, Michael Kohn interviews Army Corps of Engineer whistleblower Tommie Savage. Ms. Savage is a former contract specialist who dared to question massive government contract fraud. She was fired for bringing the fraud to light and, her case is still ongoing. Tune in to hear her story.

In the second half hour, Lindsey Williams and attorney Sharon Eubanks discuss her new book Bad Acts: The Racketeering Case Against the Tobacco Industry. Ms. Eubanks spent the last six years of her 22 years as an attorney with the Department of Justice taking on the tobacco industry. They discuss the case and the difficulties of going up against corporations with almost limitless resources.

In the first half, Richard Renner interviews author Kathleen Sharp about Mary Scott, a hospital finance administrator who blew the whistle on Metropolitan Health Corp bilking the federal government through billing fraud and kickbacks.  After the federal government reached a $6.25 million settlement agreement with Metro Health based on her whistleblowing, the company fought back hard. They convinced a judge, without a hearing, to levy a $1.6 million sanction against Ms. Scott for her lawyers’ misconduct.  Metro Health is now frustrating Ms. Scott’s attempts to pick up the pieces by opposing her bankruptcy case. Kathleen Sharp will explain this harrowing tale of how hard fraudsters can fight back against whistleblowers.

In the second half hour, Guest Host Rosemary Dew, a 13-year veteran FBI agent, interviews fellow FBI whistleblower Coleen Rowley. They discuss the Obama Administration’s use of the Espionage Act to prosecute national security whistleblowers, such as NSA whistleblower Thomas Drake.

Richard Renner interviews Professor Richard Moberly of the University of Nebraska College of Law about his recent law review article,“Sarbanes-Oxley’s Whistleblower Provisions – Ten Years Later.”  Professor Moberly has studied the SOX whistleblower protections since its enactment in 2002 and now presents an analysis of why it failed to protect us from the 2008 financial crisis. Professor Moberly’s analysis offers a number of pointers for corporate fraud whistleblowers, including whether to stay with the Department of Labor process or file in federal court. Richard and Professor Moberly also discuss how SOX fits in with the web of other whistleblower protections.
